Exzellenz,

ich bin 54 Jahre alt, arbeite als Manager Marketing und Kommunikation für eine Softwarefirma in Deutschland. In meiner Freizeit unterstütze ich Opfer der Sorge-, Trennungs- und Scheidungsindustrie in Deutschland. Mit verschiedenen türkischen Bürgern bin ich gerne in Kontakt und verbringe immer wieder gerne Urlaube in Antalya.

Meine Empfehlung an Sie: lassen Sie sich nicht von Deutschen Weltverbesserern unter Druck setzen, unterstützen Sie dringend Kazim Görgülü. Bitte missverstehen Sie meine Anmerkung nicht als eine Einmischung in Ihre Angelegenheiten.

Fall Marco, Antalya:

Den Fall Marco, wie er hier in der Presse ( http://www.morgenpost.de/desk/987637.html )

heisst, beobachte ich genau. Es gibt dazu sehr nachdenkliche Meldungen, die ich inhaltlich voll und ganz teile, insbesondere die, der Authorin Stefanie Schneider von der Berliner Morgenpost:

Die türkische Rechtsordnung ist hier keineswegs viel rigider als die anderer Länder. Das Strafrecht geht auf Frankreich und Italien zurück - und auf die EU. Ausgerechnet der nun so umstrittene Artikel 103, der Sexualkontakte zwischen Kindern unter Strafe stellt, wurde noch im Jahre 2005 im Rahmen der Beitrittverhandlungen zur EU erneuert, um das türkische Strafrecht westlichen Maßstäben anzupassen. Jetzt wird das Gesetz zum Sinnbild islamischer Rückständigkeit. Dabei wird die Tat in der Türkei mit acht Jahren Höchststrafe noch milde bestraft - in Deutschland drohen bis zu 10 Jahren Haft.

So häufig derartige Teenie-Romanzen auch vorkommen, sie bleiben ein juristisches Vabanquespiel, das auch in Deutschland hart bestraft werden kann. Selbst 14-Jährige sind in Deutschland schon wegen Kindesmissbrauchs zu Gefängnisstrafen verurteilt worden. Und eine 13-jährige ist eben hier wie dort noch ein Kind.

Kritiker sollten also vorsichtig sein, auch was die Anordnung der Untersuchungshaft durch die Türken angeht. Auch "bei uns hätte kein Staatsanwalt dem Verdächtigen gesagt: Fahre doch zurück in dein Land und komme zur Verhandlung wieder", sagt Rechtsanwalt Wowra. Warum also solle sich die Türkei also anders verhalten?

Fall Kazim Görgülü, Deutschland:

Wirklich dramatisch, menschenrechtsverletzend, willkürlich, traumatisierend und stark menschenverachtend für Kind und Familie ist, dass Deutschland, seine Exekutive in Bund und Land, seine Richter und insbesondere das Jugendamt einen türkischen Mitbürger, Kazim Görgülü daran behindern Sorge um und Umgang mit seinem Sohn Christofer zu haben. Nicht nur, dass diese Familie psychisch ruiniert und gefoltert wird, sie wird auch finanziell vollständig ausgeblutet. Wer die erschütternde Wahrheit über die Deutsche Justiz nicht glauben will, der beschäftige sich mit den Büchern des Schriftsstellers Jürgen Roth. Bürger wenden sich momentan eher an Jürgen Roth, denn an die eigene Justiz (siehe www.juergen-roth.com ).

Der Fall begann damit, dass ein Kind namens Christofer geboren wurde Anfang 1999. Zunächst blockierten das Jugendamt Leipzig und Wittenberg alles. Der Vater bekam keinen Kontakt zu seinem Sohn. Das ist erst seit 2006 möglich, nachdem der Europäischen Gerichtshof für Menschenrechte 2004 allen deutschen Ämtern und Gerichten ihr Versagen vor Augen führte und die Bundesrepublik verurteilte wegen Menschenrechtsverletzung. Wer nun gedacht hatte, der Spuk wäre vorüber, der sieht sich bis heute getäuscht von der ach so guten Deutschen Justiz und dem Jugendamt. Für einen gerecht denkenden Menschen ist das alles nicht mehr nachvollziehbar.

Die Familie Görgülü musste sich mittlerweile schon weit über 45 Gerichtsverfahren stellen, der Fall war schon sieben Mal vor dem Deutschen Verfassungsgericht, welches ebenfalls sein Versagen laufend dokumentiert, manchmal auch half. Drei Richter des Oberlandesgerichtes sind wegen Rechtsbeugung seit Ende letzen Jahres angeklagt beim Gericht in Halle. Kazim Görgülü befindet sich gerade wieder auf seiner zweiten Gerichtsachterbahnfahrt auf den Bundesgerichtshof wartend, zur zweiten Mal vor den EGMR.

Sie machen sich keine Vorstellungen mit wie viel Geld und professoralem Gepränge hier gegen ein türkisches Kind und einen türkischen Mitbürger gearbeitet wird. Ich verweise hier auf Prof. Prof. Dr. iur. Gisela Zenz, Pensionierte Universitätsprofessorin ( http://www.foster-care-research.org/1st_conference_teilnehmer.htm ) und Prof. Dr. Ludwig Salgo (Prof. FH Frankfurt), Jurist an der Fachhochschule und Universität Frankfurt am Main und einer der schärfsten Kritiker der Gemeinsamen elterlichen Sorge (siehe auch http://www.vaeternotruf.de/ludwig-salgo.htm ) .

Die Bundesrepublik Deutschland, das Land Sachsen-Anhalt und das Jugendamt Wittenberg, beide verkennen hier im Grundsatz völlig ihre Rolle.

Es gibt eine klare Entscheidung des europäischen Gerichtshofs für Menschenrechte (EGMR), diese datiert vom 26.02.2004 - Rechtssache GÖRGÜLÜ gegen DEUTSCHLAND (Individualbeschwerde Nr. 74969/01). Darin wurde Deutschland verurteilt, wegen Verletzungen von Menschenrechten.

Es ist der Bundes-Exekutive Deutschlands und der Exekutive des Landes Sachsen-Anhalt und dem Jugendamt zuzumuten, dass sie die Urteile des Europäischen Gerichtshofs für Menschenrechte beachtet und umsetzen. Es ist ebenfalls zuzumuten, dass das Urteil (BVerfG, 2 BvR 1481/04 vom 14.10.2004, Absatz-Nr. (1 - 73) des Bundesverfassungsgerichtes beachtet wird:

Bert Steffens, Andernach, schreibt am 11.06.07 auf Anfrage zu den wesentlichen Urteilen des ECHR betreffend der Fälle Görgülü und Haase:

1. Die Urteilsentscheidungen des EGMR sind keiner Auslegung zugänglich, d.h. sie sind eindeutig;

2. der Art. 25 GG ist ebenso eindeutig;
3. der Art. 97 Abs. 1 GG ist nicht weniger eindeutig und

4. die Verletzungen der EMRK sind festgestellt, womit

5. die Nichtbeachtung der EGMR-Entscheidungen durch deutsche Richter und

5.1 deren grundgesetzwidriges Auslegen und/oder Nichtbeachten des Grundgesetzes und der weiteren Gesetze, also auch

5.2 deren daraus folgende willkürliche Rechtsprechung und

5.3 deren EMRK-widriges Verhalten eindeutig belegt ist.

B)

1. Die beim EGMR verklagte BRD hat aufgrund des Art. 25 GG die Entscheidungen zu beachten, d.h. die in der Entscheidung am Schluss festgestellten

1.1 Rechtsverletzungen der Beschwerdeführer (Bf) zu beseitigen und

1.2 den Schadensersatz zu leisten.

Zu weiteren Information:

Der Beschluss (Fall Görgülü) des Zweiten Senats des Deutschen Bundesverfassungsgerichtes vom 14. Oktober 2004 - 2 BvR 1481/04 - ist eine gegen den Art. 25 GG verstoßende "Rechtskonstruktion", mehr nicht: Es muss wegen Art. 25 GG aus einem EGMR-Titel in Deutschland vollstreckt werden können, sonst ist der Art. 25 GG sinnlos - ein hohles Recht, was wiederum GG-widrig ist.

Dieser BVerfG-Beschluss zeigt wiederum:
"Juristen" können alles so "auslegen", wie es passen soll und

"Gesetzesauslegung" ist eines der Hauptübel innerhalb einer sich demokratisch nennenden Gesellschaft und verstößt zudem u.a. gegen die Gesetzesunterworfenheit aus Art. 97 Abs. 1 GG und gegen den 'Hauptsatz der Demokratie' "Alle Staatsgewalt geht vom Volke aus", denn "Gesetzesauslegung" macht den Souverän, das Volk zum Narren.

Ein wesentlicher Punkt ist jedoch auch, dass sich Verwaltung / Exekutive und Jugendamt ebenso an die Urteile des EGMR halten müssen.

Keine Frage, die Menschenrechtsverletzung an Kind, Vater und Familie dauert an, der Staatsanwalt käme nie zu spät, wenn er denn nur ermitteln würde.

Das hinter dem Agieren der Deutschen Exekutive, Gerichte und Jugendamt ein Deutsches System steckt, sehen Sie auch am EGMR-Fall der Familie Haase Münster mit sieben entzogenen Kindern, eines davon von der Mutterbrust.

Dear Mr. Ambassador,

 I am 54 years old and am employed as a communications and marketing manager for a software company in Germany. In my free time, I support victims of the thriving custody, separation and divorce industry in Germany. I have many contacts with various citizens of Turkey and I frequently spend our vacations at Antalya.

My recommendation to you is not to let yourself be placed under pressure by the German do-gooders and rather give your immediate support to Kazim Görgülü. Please do not misunderstand my comment as meddling in your business.

The case of Marco, Antalya:

I have been observing the case Marco, referred to here by the press ( http://www.morgenpost.de/desk/987637.html ), very closely. There are certain thought-provoking, comments, with which I completely agree, particularly those of the author Stefanie Schneider of the Berliner Morgenpost:

In this regard, the Turkish laws are in no way more rigid than those of other countries. The criminal law harks back to that of France and Italy and the EU. In particular, the currently so controversial Article 103, which makes sexual contact between children punishable by law, was renewed in 2005 within the framework of the negotiations for the entry of Turkey into the EU, to put Turkish criminal law in line with western standards. Now this law is being presented as an example of Islamic backwardness. On top of this, the jail sentence of 8 years in Turkey is relatively mild in Germany one can face up to 10 years in jail for the same crime.

Although such teenage romances occur frequently, they are an all-or-nothing gamble for the law, which can also result in serious punishment in Germany. Even 14 year olds have received jail sentences for sexual abuse. And a 13 year old is still a child, whether here or there.

Critics should therefore be careful, even about the decrees regarding pre-trial confinement in Turkey. “Here no public prosecutor would say to the suspect: Go back to your country and return for the trial”, says lawyer Wowra. Why, then, should it be different in Turkey?

Case of Kazim Görgülü, Germany:

A real dramatic, arbitrary, traumatising and inhuman violation of the human rights of a child and family is that Germany, its executives on the federal and state level, its judges and particularly the Jugendamt (Youth Welfare Office) are preventing a fellow Turkish citizen, Kazim Görgülü, from caring for and having contact with his son, Christofer. This family has not just been mentally and emotionally ruined it has also been financially drained. Whoever does not believe the shocking truth about the German judiciary is welcome to read the books of author Jürgen Roth. German citizens are currently more willing to turn to Jürgen Roth than put themselves at the mercy of their own judicial system (see http://www.juergen-roth.com/ ).

The case began with the birth of a boy named Christofer at the beginning of 1999. At first the Jugendamt Youth Welfare Services of Leipzig and Wittenberg blocked the father from any contact with his child and gave the baby to a foster family in preparation for adoption. The father was not able to have any contact with his son. This has only been possible since 2006 after the European Court of Human Rights confronted all the German authorities and courts with their errors and censured the German Federal Republic for its abuse of human rights. Whoever thought that this was the end of the story is still being hoodwinked by the excellent German judiciary and by the Jugendamt (Youth Welfare Services). The whole situation is no longer comprehensible to any fair-minded person.

The Görgülü family, meanwhile, has been involved in over 45 court cases. The case has come before the
German Constitutional Court
seven times, which continuously demonstrates the failure of even the highest court in Germany to function properly. Three judges of the Appellate Court have been charged with perversion of justice before a court in Halle since the end of last year. Kazim Görgülü is about to embark on his second judicial roller-coaster ride before the Federal Court (the German Supreme Court) and will probably have to go before the European Court of Human Rights for a second time..

You cannot imagine how much money and professorial ostentatiousness is being employed against a Turkish child of a Turkish citizen. I refer particularly to Prof. Gisela Zenz, retired university professor

The Federal Republic of Germany, the state of Sachsen-Anhalt and the Jugendamt (Youth Welfare Services of Wittenberg) totally misconceive their roles.

There is a clear decision of the European Court of Human Rights ( ECHR ), dating 26.02.2004 The Case of GÖRGÜLÜ versus DEUTSCHLAND (Application No. 74969/01). The court unanimously judged that Germany was guilty of human rights violations.

For further information:

The decision of the second Senate of the German Constitutional Court of the 14th October 2004 is nothing more than a “legal construction” which infringes Article 25 of the German Constitution, and nothing more. According to Article 25 of the German Constitution a decision, or part of a decision, of the ECHR must be enforceable in Germany, otherwise Article 25 is senseless- a hollow law, which is, in turn, unconstitutional.

This decision of the
Constitutional Court
once again shows that:

“Jurists” can interpret everything to suit themselves and

“Interpretation of laws“ is one of the main ills of a society which calls itself democratic. Among other things, it violates the subservience of Judges to the law, as stated in Article 97, paragraph 1 of the Constitution, as well as the fundamental tenet of democracy, “All authority flows from the consent of the people”, as “interpretation of the law” makes that which is the sovereign, the people, into fools.

However, also of utmost importance is that the Administration / Executive and the Jugendamt are also obliged to obey the decisions of the ECHR.

There is no question that the human rights violations of the child, the father and the family are still ongoing. If the public prosecutor would only get round to investigating the case, he would have his work cut out for him.

Behind the actions of the German executive, justice and Jugendamt is a German system. This was also identified by the ECHR-case of the Haase family, Muenster where seven children had been abducted, one of them directly from the mother's breast.
